A “design” is generally the shape or ornamentation of an article but can apply also to logos, computer graphics or any indicia with eye-appeal. A design may be the appearance of a complete article or part thereof. For there to be rights in respect of a design it is essential that the design is novel and that it possesses individual character . These criteria are judged by what has been previously made available to the public.
It can be possible to claim rights in a design without registration but better (i.e., more easily enforceable and longer lasting) rights are obtained through registration.
Why Should I Register My Design?
Registration of a design enables you to prevent others from using that design or anything similar thereto.
Registered designs can be licensed for use by others and sold for sometimes valuable consideration.
